With the majority and plenty of time before November, confirming a justice should be easy. But considering how the last 6 years have gone it will instead be a dumpster fire.
President Biden finally has a chance to score a much needed victory. With Justice Breyer retiring, he gets to keep a campaign promise to nominate a Black woman to the court.
Personally, I feel like it was a stupid promise to make. Now people will criticize his nominee by saying that she was selected only on those grounds and not on merit. Maybe it got him votes, but I really doubt someone looked at their ballot and went, “Well, I was going to vote for President Trump, but since Biden said he will nominate a black woman to the Supreme Court, then I’ll vote for him.” He could’ve just done it without promising it or saying that was the #1 qualification.
However, as we learned with Trump’s nominees, it can be a contentious process. The democrats have set precedent that could turn on them.
Now if Biden and his advisors were smart they would find someone who would be expected to vote like Breyer and is anti-monopolies and anti-big tech specifically. Then they would give Mitch McConnell a call and do those backroom deals they are all supposedly so good at.
But who am I kidding. These people are dumber than a box of rocks.
No, what will probably happen is, they find the most radical black woman possible. That way, the leftists like AOC will be constantly doing media hits talking about how wonderful this person is and how they are Karl Marx reincarnated. Also, because they will want to counterbalance, at least ideologically, the court’s shift to the right.
But that will get messy fast if the Republicans in the Senate have any brains. The goal will be to get at least Manchin, and possibly Sinema, on the fence. Also, it’s an election year. The Republicans might not be able to stop the nominee from being confirmed, but they should ask lots of questions about Critical Race Theory, ESG scores, gender ideology, parental rights vs school boards, masking toddlers, etc. Some of those issues are probably not relevant to the Supreme Court but we really don’t know anymore. And whether they are relevant or not, the American people deserve to know just how unhinged the nominee will be.
It is sad though that Biden could nominate a qualified black women who is confirmed easily and people will still say that it was all due to race and gender. Some people will always say those things, but after his comments there will be a lot more than normal. It also doesn’t help that Sotomayor and Kagan set a pretty low bar for women on the bench lately.
The biggest variable though is not the Senate. It’s the court’s decisions. Between now and election day we will find out if the court upholds Roe v Wade, overturns it, or modifies it. That decision will likely do way more to drive voters of one side - or both sides - to voting booths than a confirmed SCOTUS nominee or a nominee in limbo.
